These Terms of Use (“Terms”) govern your access to and use of any website, platform, content, products, services, or offerings (collectively, the “Products”) provided by 17 Commerce LLC (“17 Commerce,” “we,” “us,” or “our”).

By accessing, purchasing, or using the Products, you agree to be bound by these Terms. If you do not agree, you may not use the Products.

1. Role of 17 Commerce LLC

17 Commerce operates as a commercial representative, distributor, reseller, affiliate, and sub-affiliate manager for products developed, owned, and operated by third-party companies.

17 Commerce does not manufacture, develop, or clinically test the Products offered unless explicitly stated in writing.

Our role may include:

• Sales and marketing
• Contract facilitation
• Affiliate and sub-affiliate coordination
• Commission-based referrals
• Other functions

2. Description of Products and Use Environments

The Products may include, but are not limited to, the following categories of third-party products:

2.1 Virtual Reality Products – Healthcare, Wellness, and Senior Living

One or more VR Products represented by 17 Commerce LLC are used in:

• Healthcare provider settings
• Employee wellness programs within healthcare organizations
• Corporate wellness programs
• Senior living communities
• Assisted living and long-term care environments
• Additional wellness, educational, or therapeutic settings

These VR Products may be used to support stress reduction, anxiety management, pain distraction, relaxation, engagement, and experiential wellness.

2.2 Virtual Reality Products – Rehabilitation and Neurotherapy

Other VR Products represented by 17 Commerce LLC is designed for use by trained professionals in:

• Physical Therapy (PT)
• Occupational Therapy (OT)
• Neurotherapy and neurological rehabilitation

Use of these Products is intended to supplement, but not replace, standard therapeutic care provided by licensed professionals.

2.3 Hip Safety Shield Product

17 Commerce acts as an affiliate for a third-party company that manufactures and sells a hip safety shield Product.

This product may be sold to:

• To the general public, directly
• Long-term care (LTC) facilities
• Hospitals
• Senior living communities
• Corporations or organizations seeking to help individuals (especially women) protect their hips

17 Commerce LLC does not manufacture or warrant this Product and earns commissions through affiliate and sub-affiliate relationships.

3. Affiliate and Sub-Affiliate Disclosure

17 Commerce participates in affiliate marketing programs and may receive commissions when Products are purchased through referral links, sales representatives, or sub-affiliates.

• Sub-affiliates operate independently and are not employees or agents of 17 Commerce
• 17 Commerce is not responsible for representations, conduct, or statements made by, or any actions of, sub-affiliates
• Pricing, fulfillment, warranties, service, and returns are governed by the third-party Product owner

4. Medical, Clinical, and Safety Disclaimer

IMPORTANT NOTICE

The Products offered through 17 Commerce:

• Are not intended to diagnose, treat, cure, or prevent any disease
• Are not a substitute for professional medical advice, diagnosis, therapy, or treatment
• Should be used only in accordance with manufacturer instructions and professional standards

5. No Medical or Professional Advice

17 Commerce does not provide medical, psychological, therapeutic, rehabilitation, or safety advice.

All information provided through websites, marketing materials, presentations, or communications  of any kind are for informational and educational purposes only.

Clinical decisions, patient suitability, employee wellness participation, and safety determinations remain the sole responsibility of the purchaser, provider, employer, or end user.

6. Third-Party Products and Responsibilities

All Products are owned and controlled by their respective third-party companies.

17 Commerce:

• Makes no independent guarantees regarding Product performance, outcomes, or safety
• Does not control manufacturing, quality assurance, regulatory classification, or any aspects of Product
• Is not responsible for Product defects, recalls, misuse, or adverse outcomes

Any warranties, instructions, or support are provided solely by the third-party Product owner.

7. Purchases, Payments, and Refunds

All purchases are subject to:

• Terms disclosed at the time of sale
• Third-party vendor policies
• Applicable taxes, fees, and shipping charges

Unless otherwise stated in writing, all sales are final, and refunds or returns are governed by the applicable third-party provider.

8. Intellectual Property

All content owned by 17 Commerce - including branding, text, logos, and marketing materials is protected by intellectual property laws.

All third-party trademarks, product names, and proprietary materials remain the property of their respective owners.

Unauthorized use is prohibited.

9. User Responsibilities

You agree to:

• Follow all manufacturer instructions and warnings

Organizations are solely responsible for compliance within their facilities or programs.

10. Limitation of Liability

To the maximum extent permitted by law, 17 Commerce shall not be liable for any:

• Loss of profits
• Loss of data
• Emotional distress
• Indirect, incidental, or consequential damages

arising from or related to:

• Use or misuse of any Product
• Reliance on Product information
• Actions of third-party vendors, affiliates, or sub-affiliates
• Clinical, therapeutic, wellness, or safety outcomes

11. Indemnification

You agree to indemnify and hold harmless 17 Commerce from any claims, damages, liabilities, or expenses arising from:

• Your use of the Products
• Your resale, referral, or promotion of Products
• Your failure to comply with laws or professional standards

12. Regulatory and Legal Compliance

Users are responsible for compliance with all applicable laws, including but not limited to:

• Healthcare and professional licensing laws
• Workplace safety regulations
• Consumer protection laws
• Privacy and data protection laws (e.g., HIPAA, where applicable)

17 Commerce does not guarantee regulatory status or approvals of third-party products.

13. Disclaimer of Warranties

All Services are provided “as is” and “as available.”

17 Commerce disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement.

14. Governing Law

These Terms are governed by the laws of Palm Beach County in the state of Florida, USA, where 17 Commerce LLC is registered, without regard to conflict of law principles.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Products constitutes acceptance of the updated Terms.
